Landmark Employment Case Voids One-Sided Worker Arbitration Agreements SAN JOSE, CA - MARKET WIRE
The Juniper arbitration clause required employees to arbitrate all possible claims against their employer, while permitting the company to go to court to enforce employees' violations of their obligations to preserve company secrets. The court held that 'because illegality and unconscionability permeate the agreement -- its objectionable terms cannot be severed.
