C.Z. Carpentry Inc. fined $90,000 for health and safety violation Canada NewsWire
C.Z. Carpentry Inc., a small Toronto company that provides carpentry services to the construction industry, was fined $90,000 today for a violation of the Occupational Health and Safety Act that resulted in the death of an employee at a construction site.
On February 14, 2003, a worker was carrying a circular saw across 6.09 metres (20 feet) of a roof on a house when the worker fell about 7.9 metres (26 feet) to the ground below. The worker died on March 12, 2003. The worker had been instructed by a principal of C.Z. Carpentry to carry the saw to the roof's apex when the incident occurred. The worker was helping to cover the roof with plywood sheathing and had been told to trim a piece of the plywood. A Ministry of Labour investigation found the worker was wearing a fall-arrest harness attached to a length of rope, but the rope was not attached to anything and, as a result, the harness failed to protect the worker. The incident occurred at a house under construction on Daphnia Drive in Vaughan, Ont.
C.Z. Carpentry Inc. pleaded guilty, as an employer, to failing to ensure a guardrail, travel restraint system, fall restricting system, fall arrest system or safety net were in place at the workplace, as required by Section 26.1 of the Regulations for Construction Projects. This was contrary to Section 25(1)(c) of the act.
