Framer's Death Not the Fault of General Contractor Or Owner - ENR McGraw-Hill
Smith's family sued H&W and the church, arguing that they negligently exercised authority and control over the construction, causing Smith's death. Under Utah law, an employer of an independent contractor is not liable for physical harm to the contractor's employee, unless the employer retains affirmative control over the method or manner in which the contractor does the work.
