Under provincial law, certification in this case requires that 55 per cent of the members of the proposed bargaining unit support the union drive.
But only four members of Local 18 routinely worked for the city -- from five to 12 years, according to the union.
The union maintains one of the four was ineligible to vote because he's a foreman. One guy wasn't approached. The two others decided to unionize.
The city disputes that accounting. It argues the foreman should have been able to vote. In their books, that means the union didn't achieve the necessary 55 per cent majority.
