EDMONTON - Four of Alberta's construction unions are mounting a constitutional challenge to the province's labour laws on the basis they breach freedom-of-association guarantees in the Charter of Rights and Freedoms.
On the heels of a Supreme Court of Canada judgment in British Columbia affirming collective bargaining as a constitutionally protected right, the four unions are launching separate challenges of Alberta's Labour Relations Code, the province's main piece of labour legislation.
If successful, the lawsuits would strike down sections of the Labour Relations Code that recently barred about 4,000 industrial carpenters in the province from going on strike even though a strong majority voted for strike action.
