Agricultural workers like those at Platinum aren't allowed to join a union under the Ontario Labour Relations Act.
The union first challenged the Labour Relations Act in 1995, saying it violated the rights of farm workers.
The Supreme Court of Canada ruled in 2001 that farm workers did have the right to associate.
The province responded by creating the Agricultural Employees Protection Act, which allows workers to form associations but not join unions.
Now the UFCW is challenging the province's legislation again.
