Pate and Pate Enterprises found responsible for employee death Conroe Courier, TX
'Mr. Alvarez was standing outside the protection of the trench box when each section of pipe was lowered into place in order to remove the rigging and grout the seam. Due to the methods of construction and the size of the trench box used in the trench, employees exited the safety of the trench box each time a new section of pipe was lowered into the trench and secured.'
The OSHA investigation determined Pate and Pate Enterprises was at fault for Alvarez's death.
'Mr. Alvarez's death was caused by the Defendants' failure to provide adequate protection from cave-in to its employees working in excavations greater than 5 feet in depth in accordance with the standard,' the court documents state.------------------------------------------- posted 7:02 AM :: reference link ::
