Court throws out lawsuit against city over collapse - AP, Billings Gazette MT
In a 4-1 decision released Tuesday, the justices said the city of Missoula could not be held liable for the collapse because legislators had specifically put such liability solely on contractors and builders.
The case involved a lawsuit brought by the family of Keith Dukes of St. Ignatius. Dukes, 38, was working on a renovation project at the University of Montana in February 1998 when the scaffolding he and another worker were on collapsed. The second worker was critically injured.
