High court reaffirms free speech at malls - By Greg Moran, San Diego Union Tribune
The decision came in a nearly decade-old case involving Fashion Valley mall and a labor union representing pressroom workers at The San Diego Union-Tribune.
In October 1998, union members handed out leaflets in front of what was then the Robinsons-May store detailing their labor dispute with the newspaper. The leaflets also pointed out that the store was a heavy advertiser in the paper.
Fashion Valley, like many malls, allows protesters but requires them to get a permit from the mall and abide by the rules outlined in it. One of those rules prohibits calling for boycotts of any tenants in the mall.
