Bill C-45: Implications for Trade Unions
As readers of COS are now aware, Bill C-45 was proclaimed into law on March 31, 2004. This bill created a criminal liability for organizations and their senior representatives who have failed to take necessary steps to ensure the safety of their employees. The Westray Mine disaster on May 9, 1992 was the impetus for the bill. This incident, which claimed 26 lives, prompted a full-scale investigation by Justice K. Peter Richard, who issued a damning report: A Predictable Path to Disaster. The report concluded that the incident was, 'A story of incompetence, of mismanagement, of bureaucratic bungling, of deceit, of ruthlessness, of cover-up, of apathy, of expediency, and of cynical indifference.' Despite these conclusions no one was convicted, criminally or otherwise.
